VETERAN SECURITY SERVICES PATROL/GUARD SERVICE AGREEMENT
THIS AGREEMENT made with this date: between VETERAN SECURITY and the above referenced client referred to hereinafter as "Subscriber." WITNESSETH: That for considerations specified, the parties hereto do, for themselves, their successors and assigns, mutually covenant and agree as follows: A. The Subscriber hereby engages VETERAN SECURITY'S patrol/guard services at Subscriber's premises located at (hereinafter referred to as the "premises") for the type of service specified in the Scope of Service all on the terms and conditions herein set forth. B. Subscriber hereby agrees to pay VETERAN SECURITY, its agents or assigns a service charge in the amount of Dollars ($) per . The Subscriber shall pay such service charge during the term of the contract in accordance with the terms of the invoice rendered by VETERAN SECURITY, therefore. C. Service under this contract shall commence on the day of 50 and shall continue until terminated upon thirty (30) days prior written notice by either party to the other provided; however, that such service may not be terminated prior to ninety (90) days from the commencement date hereof. Lacking such notice of termination, this contract shall automatically renew itself from month to month until such notice is given. It being further provided that VETERAN SECURITY may discontinue furnishing services under this contract immediately upon default by the Subscriber in making any payment hereunder, where such default shall continue for a period of five (5) days or more written notice thereof to Subscriber. All National Holidays paid and billed at the overtime rate if worked. SCOPE OF SERVICE D. Subscriber agrees that he/she will not directly or indirectly, individually or for or with any other party employ any employee of VETERAN SECURITY to provide any type of service which was provided to subscriber by VETERAN SECURITY. It is also understood that Subscriber will be liable for all of VETERAN SECURITY'S losses, damages, attorney, court or any other fees, which would be the result of such actions. E. It is understood that VETERAN SECURITY is not an insurer; that insurance shall be obtained by Subscriber, if any is desired; that the sums payable hereunder to VETERAN SECURITY by Subscriber are based upon the value of services offered and the scope of liability undertaken, and such sums are not related to the value of Subscriber's interest protected or of property belonging to Subscriber or to others located on Subscriber's premises. Subscriber does not seek indemnity by this agreement from VETERAN SECURITY against any damages or losses caused by hazards to Subscriber's property. VETERAN SECURITY makes no warranty, express or implied, that the services it furnishes will avert or prevent occurrences, or the consequences therefrom, which such service are designed to detect and the failure of which may result in loss or damage to the Subscriber. Subscriber agrees that VETERAN SECURITY shall not be liable for any of Subscriber's losses or damages, irrespective of origin, to person or to property, whether directly or indirectly caused by performance or nonperformance of obligations imposed by this Agreement or by negligent acts or omissions of VETERAN SECURITY, its agents, or employees. The Subscriber does hereby waive and release any rights of recovery against VETERAN SECURITY that it may have hereunder. It is agreed that it is impractical and extremely difficult to fix actual damages, if any, which may proximately result from a failure of services in any respect and, therefore, VETERAN SECURITY and the Subscriber agree that VETERAN SECURITY'S liability shall in no event exceed the sum of $50 as agreed upon liquidated damages, and not as a penalty, and the recovery of an amount within such limit shall be Subscriber's sole remedy at law or in equity.
